The designers of the Geneva Convention would be appalled that there would even be a debate as to whether it covered the treatment of a fifteen-year old boy, and that it is acceptable to treat him worse than those adult men who are covered.

If he is not considered a soldier he is covered under UN Security Council Resolution 1612, of which the US is a signatory, covering the treatment of child combatants engaged in armed conflict. If the US government ignores the agreement it signed, then he is an enemy combatant and covered by the Geneva Convention, or is simply a criminal. Either way his current treatment is illegal under both US law and every civilized law pertaining to conflict in the world.

Under the 'rules of war', or the Geneva Convention, he is not considered a 'soldier'; thus he is not a POW. That is why basic Geneva Convention rules do not apply to Omar.
Though even IF they did apply to him, he would still technically be in Guantanamo, until the White House deemed 'The War on Terror' ceased. - How long will that take? Forever!
I can't wait until Obama closes Guantanamo, however these 'terrorists' still need to be charged and put up on trial.
